Terms of Service

1. Agreement to terms

These terms apply to anyone who uses velocube.net, submits a quote request, or hires Velocube ("we," "us") for a project or ongoing service. By using this site or hiring us, you agree to these terms. If you don't agree, please don't use the site or our services.

2. Our services

Velocube provides web and app development, hosting and website management, branding and design, SEO, and related digital services, as described on our Services page. The exact scope of any project is defined in the quote or proposal we send you, not by this page alone.

3. Quotes and pricing

Prices shown on this site, including on our Pricing and Hosting pages, are starting points. Every project is quoted individually based on what it actually needs, and a quote is only final once we confirm it with you in writing (typically by email). Prices are subject to change for new quotes, but won't change on a project we've already agreed to without your consent.

4. Payment terms

Project work. A deposit is due before work begins on most project builds. The deposit is non-refundable once work has started, since it covers time we've committed to your project. Remaining milestones are billed as they're delivered, not upfront.

Late or failed payments. If a payment fails, we'll reach out before taking any other action. Continued non-payment may result in work pausing until the account is current.

5. Hosting and subscriptions

Hosting and other monthly plans can be cancelled at any time, effective at the end of your current paid period. There are no partial-month refunds. If you're on a discounted term (3, 6, or 12 months), cancelling early forfeits the discount on the months already used; we'll calculate the adjustment with you directly.

6. Your responsibilities

• Provide accurate information, content, and access needed to complete your project
• Respond to requests for feedback or approval in a reasonable time, since delays can push back your timeline
• Keep your client portal login secure and let us know right away if you think it's been compromised
• Only use content and materials you have the right to use in your project

7. Ownership and intellectual property

Once a project is paid in full, you own the final deliverables we build for you (for example, your website's design and content). Velocube retains the right to reuse general techniques, code patterns, and know-how developed during your project on other work, and to reference completed projects in our own portfolio and marketing unless we've agreed otherwise in writing.

8. Acceptable use

If we host your site or you have access to a Velocube client portal, you agree not to use it for anything illegal, to distribute malware, or to attempt to access another client's data or account. We may suspend access if we reasonably believe this is happening.

9. Disclaimers and liability

We work carefully, but we can't guarantee a website or app will be completely free of bugs, or that hosting will never have downtime, though we target 99.9% uptime on hosted plans. To the extent allowed by law, Velocube isn't liable for indirect, incidental, or consequential damages arising from our services, and our total liability for any claim is limited to the amount you paid us for the service in question over the prior 12 months.

10. Termination

You can stop working with us at any time; see the payment and hosting sections above for how that affects billing. We may pause or end services if payment is significantly overdue, or if these terms are being violated, and we'll make a reasonable effort to give you notice first.

11. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of law principles.

12. Changes to these terms

We may update these terms from time to time. If we make a meaningful change, we'll update the date at the top of this page. Continuing to use our services after a change means you accept the updated terms.
